Preamble

These general conditions of sale ("The General Conditions") are agreed to between THE SOCKS OFFICE and any private individual ("The User") wishing to make a purchase on the Web Site (henceforth referred to collectively as "The Parties").

The Parties agree that their relationship is governed solely by these General Conditions. THE SOCKS OFFICE reserves the right to amend these General Conditions at any time. They will apply from the time they are published on line and only for orders placed after said publication.

In the event of any condition of sale being absent from these conditions, it will be deemed to be governed by current common practice in the distance sales sector among companies with headquarters in France.

THE SOCKS OFFICE undertakes to adhere to the terms of the French Consumer Code, and specifically those pertaining to distance selling.

Article 1 Purpose

The purpose of the General Conditions is to set out the terms and conditions of sales between THE SOCKS OFFICE and The User from placement of the order to after-sales services, including payment and delivery.

Article 2 Products

Products covered by these General Conditions are those appearing on the Web Site ("The Products").

The Products are described and portrayed as accurately as possible. However, should any errors or omissions occur, THE SOCKS OFFICE undertakes to put these right as soon as possible.

Article 3 Prices

Prices for The Products are stated in Euros, inclusive of all taxes. They include VAT and any discounts applicable on the day of ordering.

Prices for Products are implicitly specified excluding delivery fees (packing, carriage and handling at applicable rates). The amount charged for delivery will be specified on the order form prior to confirmation of the order.

Should any taxes or levies, including environmental impact taxes, be introduced or amended, either upwards or downwards, that change may be reflected in the sales price of the Products offered on the Web Site and other sales media.

However, prices may not be changed once the User's order has been confirmed.

Article 4 - Order

4.1 User login prior to ordering

To place an order, the User must log in using their e-mail address and password. For all initial orders, the User must go through the account setup procedure specified on the Web Site.

In the event of a lost or forgotten password, The User may ask for their password to be re-sent by going to their customer account and clicking on "Forgotten password". They will then receive a new password to the e-mail address provided at the time of signing up, which they will then need to change and customise.

4.2 Registration and confirmation of order

The User places their order on line from the on-line catalogue.

Once they have checked their basket, The User must accept the General Conditions, choose the address and delivery method and finally confirm the method of payment; the last of these stages formalises the sales contract between THE SOCKS OFFICE and The User.

Any order requires payment.

Any order is taken to imply that The User accepts the product prices and descriptions available at the time of the sale. Any dispute will be subject to the exchange and guarantee policies set out below (Article 7).

Upon confirmation of the order, THE SOCKS OFFICE will acknowledge receipt thereof by e-mail within two (2) working days.

In the event of non-payment, the order will be automatically suspended until the issue is resolved.

In the unlikely event that it should come to light that a product is unavailable once an order has been placed, The User will be immediately informed by e-mail and will be offered either an immediate refund or a replacement for the product in question.

For all matters relating to order tracking, The User must check their customer account on the web site or call customer service on 0344464606 Mondays to Fridays, 8:30am-12pm and 1pm-7:30pm; local call charges will apply from land lines within Metropolitan France.

THE SOCKS OFFICE sometimes offers special discounts or promotions to customers; these are for their intended recipient only. Such promotions are for one-time use and non-transferable.

Article 5 - Terms of payment

Payments for on-line orders are made at the time of ordering

The User may choose to pay for their purchases by any of the following methods:

By bank cheque:

Where payment is made by cheque, the cheque must be drawn on an account held with a bank domiciled in France. Cheques are cashed as soon as we receive them. Cheques must be sent to The Socks Office, Service Commande Internet 37 rue des Bonnetiers 60220 Moliens - France.

By credit or debit card:

Carte Bleue, e-carte bleue, Visa, Mastercard. For orders from countries outside France, on-line payment must be made by credit or debit card

In the case of credit or debit card payments, The Customer expressly acknowledges that by providing their card account number to THE SOCKS OFFICE, they implicitly agree to their account being debited for the price of the products being ordered. The www.achile.com web site uses a secure payment system: THE SOCKS OFFICE has opted for the secure payment system provided by CIC in the form of SSL (Secure Socket Layer) technology which, through the use of cryptography, ensures the integrity and privacy of data transmitted over the Internet. The total amount for the order is debited from the Customer's account at the time the order is confirmed. Your payment request is routed in real time to the Crédit Mutuel - CIC secure remote payment handler, which conducts a number of anti-fraud checks.

By PayPal :

With PayPal, you can pay by simply entering an e-mail address and password or your credit card. Using the PayPal payment system, which encrypts and protects your bank details. If you are paying for your purchases in euros or pounds sterling within the EEA (European Economic Area), the commission will be absorbed by THE SOCKS OFFICE.

Article 6 - Delivery

Products purchased on www.achile.com can be delivered to Metropolitan France, within the European Union, or to the rest of the world, including French overseas departments and territories.

6.1 - Products are delivered to the address specified at the time the Customer places their order. Delivery time is 2-5 working days from placement of the order in the case of orders for delivery in France, and 6-12 working days from placement of the order in the case of orders for international delivery or delivery to French overseas departments and territories. The specified delivery times are usual average times and represent processing and delivery time.

Nevertheless, should the Products ordered not be delivered within the expected time for any reason except a force majeure or the fault of the customer, the sale may be terminated at the Customer's written request (by registered letter with acknowledgement of receipt or any other permanent medium) under the conditions set out in Article L138-2 of the French Consumer Code. Monies paid by the Customer will then be refunded to them within two weeks of the date the contract is terminated, less any penalty fee that may be withheld.

  • Rest of world, at home with signature, 15,50 € jusqu'à 100 € , after which delivery is free.



Shipments to Metropolitan France are sent via the Colissimo 48/72 hour tracked service.

For shipments to Europe and the rest of the world, the customer is provided with a tracking number.

Where payment is by cheque, the order will be processed once the cheque has been cashed, which occurs upon receipt thereof. As a result, the delivery schedule will be calculated as of the date the aforementioned cheque is cashed. THE SOCKS OFFICE undertakes to let the Customer know about any foreseeable delay to delivery. Ownership of the goods and associated risks are transferred to the Customer once the Customer take possession of those goods.

6.2 - Delivery problems: The Customer must notify the carrier and THE SOCKS OFFICE of any discrepancies with the good(s) delivered (e.g. package damaged, already open, missing, etc) within 3 days of receipt. The Customer may give such notice, as they so choose, either by e-mail at message@achile.com or by post at THE SOCKS OFFICE, Service Clients Internet 37 rue des Bonnetiers 60220 Moliens - France.

Product compliance: THE SOCKS OFFICE undertakes to offer the Customer either a refund or exchange, as the Customer wishes, for goods that are faulty or which do not match the order. In that case, the Customer shall return the product(s) in question, undamaged, unworn, unspoilt, in their original packaging, along with written details of the issue, to the following address: THE SOCKS OFFICE Service Clients 37 rue des Bonnetiers 60220 Moliens - France.

6.4 - THE SOCKS OFFICE will then proceed to exchange or refund, as applicable, the non compliant product(s) in question. The request must be made within 14 days of delivery. Any refund will be made within 30 days of the request for a refund.

6.5 - The products must be returned to us in the condition in which the Customer received them, unused, undamaged, labelled and package in their original packaging.

Article 7 - Cooling-off period

7.1. Exercising your right to withdraw from the sale within the cooling-off period

The User is entitled to a cooling-off period of fourteen (14) days from the date of receiving or collecting the Products. During this period, The User may return any Products that they are not satisfied with, without giving a reason.

To exercise their right to the cooling-off period, The User must inform THE SOCKS OFFICE of their decision to withdraw from the sale by completing the return form, which can be downloaded via the following link: Download here. The User must return their order, along with the aforementioned form, to: THE SOCKS OFFICE, 37 rue des Bonnetiers 60220 Moliens. Products are returned at The User's expense (except for goods that are defective upon arrival, or where there is an error at the time of shipping the Product).

7.2. Outcome

THE SOCKS OFFICE will refund the User for the full amount paid by the User for the Product(s) being returned, plus standard delivery fees, if the User is returning their entire order (minus any additional charges arising from the fact that The User chose a method of delivery other than the standard delivery offered by THE SOCKS OFFICE).

The refund will be issued via the same method of payment used by The User when placing their order.

THE SOCKS OFFICE undertakes to refund any User exercising their right to the cooling-off period for the total amount for the Products being returned, as soon as possible and within fourteen (14) days of receipt of the Product(s) by THE SOCKS OFFICE.

The Products must be intact, complete, unworn, undamaged and in their original packaging.

Where The User is not returning their entire order and is keeping one or more of the Products ordered, the total for standard delivery charges "one way" will be retained by THE SOCKS OFFICE.

Article 8 - Guarantees

8.1 Content of the guarantee

All Products offered for sale on the Web Site are covered by a statutory trade descriptions guarantee (L211-1 et seq of the Consumer Code) and warranty against hidden defects (Articles 1641 et seq of the Civil Code), meaning that the User may return any goods that are faulty on arrival or which do not match their description.

8.1.1 Statutory trade descriptions guarantee

Article L211-4 of the Consumer Code: The vendor is required to deliver a good as specified in the contract and is accountable for any discrepancy at the time of delivery. The vendor is also accountable for any discrepancies with respect to packaging or assembly instructions, or installation where they are contractually responsible for installation or where installation was carried out under their responsibility.

Article L211-5 of the Consumer Code: To comply with the contract, the product must:

1? Be fit for the use commonly expected of a similar good and, where applicable:

- match the description given by the vendor and have the qualities presented to the purchaser in the form of any sample or model";

- exhibit the qualities that a purchaser may reasonably expect given the claims publicly made by the vendor, by the producer or respective representative, including but not restricted to advertising and labelling;

2? Or exhibit the characteristics established by mutual agreement between the parties or be fit for any specific use sought by the purchaser which was brought to the attention of the vendor and to which the vendor agreed.

Article L211-7 of the Consumer Code Any discrepancies coming to light within six months of delivery of the good are deemed to exist at the time of delivery, unless it can be proven otherwise.

< >Article L211-12 of the Consumer Code: Any claim for non-compliance with customers' orders or product descriptions must be brought within two years of delivery.

8.1.2 Guarantee against hidden defects

Article 1641 of the Civil Code The vendor is required to guarantee the item being sold against any hidden defects that may render it unfit for the intended use, or which may detract from that use to such an extent that the purchaser would not have purchased it, or would have done so at a lower price, knowing that those defects existed.

Article 1645 of the Civil Code: Should the vendor have been aware of the item's defects, they are liable, in addition to reimbursing the amount they received, for any compensation due to the purchaser.

Article 1646 of the Civil Code: Where the vendor was unaware of the item's defects, they will be liable only for refunding the purchase price and refunding the purchaser for any expenses incurred by the sale.

Article 1648 of the Civil Code: Any claim relating to defects deemed inadmissible must be brought by the purchaser within two years of the defect being discovered.

8.2 Claims procedure

Where a defect, as defined under 8.1, is discovered by the User, they must provide the vendor with written notice within one (1) month of:

- delivery in the case of a product discrepancy

- discovery of the defect in the case of a hidden defect

Where THE SOCKS OFFICE confirms that the defect is genuine, they will refund or replace the faulty Products.

Shipping fees will be reimbursed on the basis of the amount billed and return costs will be refunded on presentation of corresponding receipts.

Refunds for Products deemed to be non-compliant or defective will be made as soon as possible, and within fourteen (14) days of the discrepancy or hidden defect being confirmed by THE SOCKS OFFICE.

Refunds will be made via the same payment method used by the User when placing the order.

In all events, the guarantee offered to the User is limited to the replacement of or reimbursement for non-compliant or defective Products.

Article 9 - Signature and evidence

providing a credit or debit card number through the secure CIC web site along with final confirmation of the order is deemed to constitute proof of the order under the 13 March 2000 Act implemented by Article 1316-1 of the Civil Code and elsewhere, and will cause the amounts for the Products entered into the order form to be due.

This confirmation is deemed to be equivalent to signing and accepting all transactions made over the web site.

Nonetheless, in the event of fraudulent use of their credit or debit card, The User is advised to contact Customer Service on 0344464606 as soon as they become aware of the fraud.

The computer records, retained on the computer systems of THE SOCKS OFFICE and its partners under reasonable security conditions, will be deemed to constitute evidence of communications, orders and payments occurring between the parties.

Order forms and invoices are archived on a reliable and long-lasting medium so as to constitute a faithful, lasting copy as set out in Article 1348 of the Civil Code and Article L121-16 3 ? of the Consumer Code.

Article 10 Liability

THE SOCKS OFFICE has a liability to perform at all stages of order placement and subsequent stages once the contract is entered into.

Therefore, THE SOCKS OFFICE undertakes to describe products sold on the Web Site as accurately as possible. Conversely, THE SOCKS OFFICE shall not be held liable in the event of any failure to meet its obligations attributable to the unforeseeable or unavoidable result of either the actions any third party to the contract or a force majeure as defined in French law.

Similarly, THE SOCKS OFFICE may not be held liable for any inconvenience or damage arising from the use of the Internet network, including service interruptions, hacking or computer viruses.

Article 11 - Intellectual Property

All components of the web site, whether sound or visual, including the underlying technology, are protected by copyright, trademarks or patents. Similarly, the trademarks, logos, designs and patterns appearing on the Web Site are the exclusive property of THE SOCKS OFFICE. The disclosure thereof shall in no way be interpreted as granting a licence or usage rights of any nature whatsoever to these copyrighted trademarks and distinctive elements. Such use would therefore constitute an infringement of copyright.

Therefore, no document originating from the Web Site may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any manner whatsoever.

However, it is possible to download a copy of the documents to a computer for The User's personal use, for non-commercial use only, provided that The User does not modify the information contained therein and retains all copyright and notices of ownership as is. Modification of these documents or the use thereof for any other purpose constitutes an infringement of ACHILE's intellectual property rights.

Any User with a personal web site wishing to place a simple link on their web site that points directly to the Web Site home page MUST request permission from THE SOCKS OFFICE. This will not constitute an affiliation agreement under any circumstances.

Conversely, any hypertext link to the Web Site that uses frames or inline linking is strictly forbidden. In all circumstances, any link shall be removed at THE SOCKS OFFICE's request.

Article 12 - Personally identifiable information

Personally identifiable information is required from the User and collected for the purposes of on-line sales. This information is necessary for processing and delivering orders and for invoicing purposes. This information is kept strictly confidential and processed in accordance with the French Data Protection Act of 6 January 1978 under the conditions set out in our Data Privacy Policy.

Collection of personally identifiable data is required for us to register orders. By providing their e-mail address, this allows The User to receive confirmation of their order plus, subject to their express permission, information about promotional offers and events organised by THE SOCKS OFFICE.

Article 13 - Applicable law and jurisdiction

These General Conditions are subject to French law.

In the event of any dispute, an amicable resolution will be sought prior to any legal action. Where the parties fail to reach an agreement, the court of jurisdiction will be that of the defending party's domicile or, where the claimant so chooses, the actual place of delivery of the Product.

In any event, under Article L133-4 of the Consumer Code, the Customer is entitled to seek the recourse of standard arbitration procedures, including the consumer ombudsman ("Médiation de la consommation", L534-7 of the Consumer Code) or any other alternative form of dispute resolution.

The Web Site complies with French legislation. Under no circumstances does THE SOCKS OFFICE give any guarantee that the web site willy comply with any local legislation to which you may be subject when accessing the Web Site from any country other than France.
